Islamic law and Oriental philosophy: A comprehensive diversion of ideological evolution (A special study of Hallaq’s thoughts)

Islam's practical teachings include a comprehensive scientific and research narrative for society and individual transformation. The rule of law is the key to societies' overall well-being. In accordance with divine directives, the establishment and growth of Islamic civilization was accomplished during the time of the last Prophet (peace and blessings of Allah be upon him). The practical implementation of these laws led to all further advancements. The greatest attempts were made to cast doubt on the origins and applicability of the same rule starting in the colonial era by orientalists. Sheldon Amos, Ignac Goldziher, Joseph Schacht, Black Macdonald, N. J Coulson, Shelomo Dov Goitein, Norman D. Anderson and Wael Hallaq are all well-known characters in this series. The change and evolution of their views on Islamic law is an undeniable fact. It is crucial to conduct research on Islamic law and international law given the increasing issues facing contemporary states. The failure of human-made international rules to uphold justice and peace at the UN level, along with the influence of colonialism preventing modern Muslim governments from implementing Islamic law, is another reason why the number of Western experts studying Islamic law is rising. Western scholars are currently dealing with two issues: on the one hand, the failure of modern laws has become evident, while on the other hand, the experience of Islamic laws is becoming inevitable. As a result, Western academics and researchers have turned their attention to Islamic law, and their theories are always evolving. Within this framework, this article provides a synopsis of the conceptual evolution and advancement of orientalists, particularly the modern orientalist Wael Hallaq, who have worked on Islamic law.
